What Is a T Visa?

The T visa is a nonimmigrant visa that allows victims of human trafficking to remain in the United States for up to four years. T visa holders can access work authorization, apply for certain public benefits, and eventually pursue lawful permanent residence (green card) after three years or when the investigation/prosecution is complete.

This immigration option is intended to support survivors of labor trafficking or sex trafficking who are physically present in the U.S. due to trafficking and who are willing to assist law enforcement efforts (with some exceptions for minors and trauma survivors).

T Visa Eligibility Requirements

To qualify for a T visa, you must generally meet the following requirements:

  • You are a victim of a severe form of trafficking in persons, which includes:

    • Sex trafficking (induced by force, fraud, or coercion, or involving minors)

    • Labor trafficking (involuntary servitude, debt bondage, or forced labor)

  • You are physically present in the U.S. because of trafficking

  • You have complied with reasonable requests for assistance from law enforcement (unless under 18 or unable to cooperate due to trauma)

  • You would suffer extreme hardship if removed from the U.S.

  • You are admissible or qualify for a waiver of inadmissibility
