Removal of Conditions on Permanent Residence Form I-751 Help

If you received your green card through marriage and your marriage was less than two years old at the time of approval, you were granted conditional permanent resident status. This conditional green card is valid for two years, and to maintain your lawful status, you must file to remove the conditions before it expires.

What Is a Conditional Green Card?

A conditional green card is issued to foreign national spouses of U.S. citizens or lawful permanent residents when the marriage is less than two years old at the time of approval. This condition is placed to help U.S. Citizenship and Immigration Services (USCIS) verify that the marriage is genuine and not entered into solely for immigration purposes.

How to Remove Conditions on Permanent Residence

To keep your permanent resident status, you must file Form I-751, Petition to Remove Conditions on Residence, during the 90-day period before your conditional green card expires.

  • In most cases, both spouses must file the petition jointly.

  • You must provide evidence that your marriage is bona fide, including joint financial records, shared housing, and other proof of your ongoing marital relationship.

  • If you do not file on time, you may be placed in removal (deportation) proceedings.

What If You Cannot File Jointly?

If the marriage has ended or you are unable to file with your spouse, you may still qualify for a waiver of the joint filing requirement under certain conditions, such as:

  • Divorce or annulment after a good-faith marriage

  • Abuse or extreme cruelty by the U.S. citizen or LPR spouse (VAWA-based I-751)

  • Extreme hardship if removed from the United States
