K-1 Fiancé(e) Visa

What Is a K-1 Fiancé(e) Visa?

The K-1 visa is a nonimmigrant visa that allows the foreign national fiancé(e) of a U.S. citizen to travel to the United States. After entering the U.S. on a K-1 visa, the couple must marry within 90 days. Once married, the foreign spouse can apply for a green card through marriage.

Steps to Obtaining a Fiancé(e) Visa

  • Petition for Fiancé(e):
    The U.S. citizen files Form I-129F, Petition for Alien Fiancé(e), with U.S. Citizenship and Immigration Services (USCIS).

  • Visa Processing:
    Once USCIS approves the petition, it is sent to the U.S. Embassy or Consulate where the foreign fiancé(e) will apply for the K-1 visa and attend an interview.

  • Entry to the U.S. and Marriage:
    If the visa is approved, the foreign fiancé(e) travels to the U.S. and must marry the U.S. citizen within 90 days of arrival.

  • Adjustment of Status:
    After the marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident (green card holder).
